Selling an Inherited or Family Home in Flagler & St. Johns County
An inherited Florida home can often be sold during or after probate, once the right person has legal authority to sign. Depending on the will and homestead status, that may be the personal representative or the heirs. Your Florida probate attorney confirms who that is. Meanwhile, a local agent can value the home, secure it, and plan as-is versus prepared options.

First steps after a loved one passes
There is no rush. When your family is ready, these steps help:
- ⌂Step 1Secure the home and its insurance.Lock up, and call the insurance carrier about the home being vacant.
- ☰Step 2Gather the papers. The deed, the will or trust, and any estate documents.
- ⚖Step 3Talk with a Florida probate attorney. They will tell you who can act for the estate.
- ★Step 4Get a value.Knowing what the home is worth helps the family make decisions together.
Who can sign to sell the house
Authority depends on the will, the probate process and whether the home was protected homestead. Some homes pass outside probate, for example through a trust. Your attorney confirms who can sign before any contract.
This is general information, not legal or tax advice. Please talk with a Florida probate attorney (and a tax professional) about your situation.
Your Options
Sell as-is or prepare it first?
I put the options side by side: the likely net if you sell as-is, and the likely net after some preparation. Both come from my hand-built analysis of real sales nearby, so your family can choose with clear numbers. Request your home value · What to fix before you list
When the family lives far away
Many of the families I help live out of state. You don’t have to fly in for every step; see selling your home from out of state.
How I help families
I work alongside your attorney and the title company, coordinate access, contractors and vendors at the house, and keep every heir updated so no one is left out. When it’s time, the home is marketed with my Live Like a Local video series (see my marketing plan) to reach the right buyer.
Looking after the empty house
While the home sits empty, I can personally stop by for vacant-home checks between listing and closing, as often as we agree. I check doors and windows, look for signs of leaks, clear mail and flyers, and make sure the AC is running, then let your family know how it looks.
Need the house cleaned out? I can refer trusted local clean-out companies. Ask Marilynn for referrals or call (904) 429-2829.
I’m a Seller Representative Specialist (SRS®) and a Seniors Real Estate Specialist (SRES®), which means training in serving older adults and their families. I also hold the ABR® designation.

It depends on the will, the probate process and the home’s homestead status. Ask your Florida probate attorney who has authority.
